1.1 What these terms cover: These Website Terms of Use (these "Terms of Use") contain the terms and conditions that govern your access to and use of our various website(s) (the "Sites" and all data, text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, artwork and computer code made available by or through the Sites ("Content"). This is an agreement between you or the entity you represent ("you" or “your”) and us. We are willing to grant access to and use of the Sites to you solely upon your acceptance of all the terms and conditions of these Terms of Use without modification.
1.2 Why you should read them: Please read these Terms of Use carefully before you start to use the Sites, as these will apply to your use of our Sites. By using our Sites, you confirm that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, you must not use our Sites. Bamford may, at its sole discretion, disable and terminate access to the Sites and Content by any persons or entity that violate these Terms Of Use.
1.3 Print or Save: You should print a copy of these Terms of Use or save them to your device for future reference.
1.4 Legal rights: As a consumer, you have legal rights. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
2.1 Privacy Policy: Our Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our Sites, you consent to such processing and you warrant that all data provided by you is accurate.
2.2 Cookie Policy: Our Cookie Policy, which sets out information about the cookies on our Sites. The Cookie Policy relevant to each of our Sites is available on each Sites.
2.3 Other Terms: If you purchase goods and/or services from us through our Site, there are separate terms and conditions regarding such purchases that you will be made aware of during such transaction process.
2.4 Third Party Terms: Where our Sites may contain links to other Sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those Sites, including their terms and conditions or privacy policies or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

3.1 Who we are. Bamford Collection is the overarching umbrella brand name covering the following entities:
A. Bamford Collection Limited, a company registered in England as a limited liability company with company number 03064811 and VAT number GB823857801 whose registered office and main trading address is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG, which is the entity which carries out central functions for other entities making up the Bamford Collection;
B. Daylesford Organic Limited, a company registered in England as a limited liability company with company number 03868901 and VAT number GB800298256 whose registered office is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG, the activities of which include online sales of goods and events via https://www.daylesford.com/ and the operation of farm shops and cafes and events;
C. Bamford Limited, a company registered in England as a limited liability company with company number 04950734 and VAT number GB823857801, whose registered office is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG, the activities of which include online sales of goods and services via https://www.bamford.com/ (including www.bamford.com/us) and the operation of stores selling clothing and bath and body products, The Club by Bamford and directly owned spas;
D. Daylesford Stays being the overarching umbrella brand name for the group of companies which is made up of:
(i) Thrip Enterprises LLP, a company registered in England as a limited liability partnership with company number OC375071 and VAT number GB139293490, whose registered office is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG and which operates The Wild Rabbit including food and beverage sales, accommodation and events and Daylesford Cottages with the Sites(s) of https://thewildrabbit.co.uk/.
(ii) Daylesford Stays LLP, a company registered in England as a limited liability partnership with company number OC433190 and VAT number GB369145472, whose registered office is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG which operates The Fox and The Bell including food and beverage sales, accommodation and events with the Sites(s) of https://thefoxatoddington.com/, https://www.thebellatcharlbury.com;
(iii) Windrush Taverns Limited, a company registered in England as a limited liability company with company number 08096787 and VAT number GB136193710, whose registered office is at The Hive, Daylesford Farm, Moreton in Marsh, GL560YG which operates The Three Horseshoes (previously named The Maytime) including food and beverage sales, accommodation and events with the Sites(s) of https://themaytime.com/, www.threehorseshoesasthall.com.
Further hospitality venues may be added to the Daylesford Stays brand over time either by separate legal entities or through such properties being owned by one of the above legal entities and these Terms of Use shall cover any Sites for such new properties.
The entities listed above are collectively referred to as “Bamford” in these Terms of Use.
4. CHANGES TO THESE TERMS
We may revise these Terms of Use at any time by amending this page. Please check this page from time to time to take notice of any changes we made, as they are binding on you.
5. CHANGES TO OUR SITE
We may update our Sites from time to time and may change the Content at any time. However, please note that any of the Content on our Sites may be out of date at any given time, and we are under no obligation to update it.
6. ACCESSING OUR SITE
6.1 No guaranteed access: Our Sites are made available free of charge for you to access, subject to your compliance with these Terms of Use. We do not guarantee that our Sites, or any Content, will always be available or be uninterrupted. Access to our Sites is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Sites without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
6.2 Notification to others: You are also responsible for ensuring that all persons who access our Sites through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

However, you remain ultimately responsible for any such person’s access and any breach of these Terms of Use.
6.4 Your compliance: You will strictly adhere to all laws, rules, regulations and Bamford policies applicable to the access and use of the Sites, including those laws, rules and regulations that apply to online conduct, online Content, and the export of data to and from the United Kingdom and your country of residence. In addition, you will not:
• Access, acquire, copy or monitor any portion of the Sites, including through the use of any "deep-link", "page-scrape", or other automatic device, program, algorithm or methodology.
• Attempt to gain unauthorized access to any portion or feature of the Sites.
• Take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Bamford's systems or networks, or any systems or networks connected to the Site or to Bamford.
• Use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or with any other person's use of the Sites.
• Distribute viruses or any other technologies that may harm Bamford or the interests of property any other person or entity, including any other user of the Sites.
• Use the Site for any purpose that is unlawful, prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Bamford or others.
6.5 Account and Password: If you choose, or we provide you with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at guest.services@bamford.co.uk. You will remain ultimately responsible for any access of our site through your user identification code or password and any breach of these Terms of Use.
7. INTELLECTUAL PROPERTY RIGHTS
7.1 Ownership: You acknowledge and agree Bamford owns all rights in or relating to the Site and Content, including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of the Content contained on the Site ("Bamford IP"), and no ownership passes to you. You have no right, license, or interest in any rights in or relating to the Sites, Content, Bamford IP, or any replacements, improvements, updates, enhancements, derivative works and other modifications thereon.
You acknowledge and agree the Bamford name, any Bamford logo, and all related names, logos, product and service names, designs, and slogans are trademarks or service marks of Bamford as Bamford IP. You must not use such marks without the prior written permission of Bamford. Any other names, logos, product and service names, designs, and slogans on the Sites are the trademarks of their respective owners. Under no circumstances will you acquire any ownership rights or other interest in any such marks or Content on the Site by or through your use of the Sites.
7.2 No use: You must not use any part of the Content on our Sites for commercial purposes without obtaining a licence to do so from us or our licensors.
8. NO RELIANCE ON INFORMATION
8.1 Information only: The information presented on or through the Sites, including text, images, and links, is made available "as is" by Bamford solely as a convenience to you for general information purposes, without warranty of any kind, and does not constitute any type of advice. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.
8.2 Possibility of errors: Although we make reasonable efforts to update the information on our Sites, we make no representations, warranties or guarantees, whether express or implied, that the content on our Sites is accurate, complete or up-to-date. We do not guarantee that our Sites, or any content on it, will be free from errors or omissions. The Site could include technical or other inaccuracies, and not all products or services referenced on the Site are available in all areas. Changes are periodically added to the information, and Bamford may change the products or services described in the Site at any time.
9. LIMITATION OF OUR LIABILITY
9.1 Statutory liability: Bamford, its directors, officers, employees, suppliers, affiliates, agents, representatives, and licensors (the "Bamford Parties") disclaim any responsibility for any harm resulting from your use of the Site or Content, except nothing in these Terms of Use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
9.2 Exclusion of liability: To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to our Sites or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- These Terms of Use;
- use of, or inability to use, our Sites; or
- use of or reliance on any content displayed on our Sites.
If you are a business user, please note that in particular, we will not be liable for:
- loss of profits, sales, business, or revenue;
- business interruption;
- loss of anticipated savings;
- loss of business opportunity, goodwill or reputation; or
- any indirect or consequential loss or damage.
If you are a consumer user, please note that we only provide our Sites for domestic and private use. You agree not to use our Sites for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
9.3 IT: We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Sites or to your downloading of any Content on it, or on any website linked to it.
9.4 Other: We assume no responsibility for the content of websites linked on our Sites. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.
Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods and/or services, which will be set out in our terms and conditions of supply as referred to in Section 2.3.
10. VIRUSES
10.1 No guarantees: We do not guarantee that our Sites will be secure or free from bugs or viruses.
10.2 User responsibility: You are responsible for configuring your information technology, computer programmes and platform in order to access our Sites. You should use your own virus protection software.
10.3 No misuse: You must not misuse our Sites by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Sites, the server on which our Sites is stored or any server, computer or database connected to our Sites. You must not attack our Sites via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Sites will cease immediately.
11. LINKING TO OUR SITE
11.1 Fair use: You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
11.2 No endorsement and restrictions: You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Our Site must not be framed on any other Sites, nor may you create a link to any part of our Sites other than the home page. You must not establish a link to our Sites in any website that is not owned by you.
11.3 Reservation of rights: We reserve the right to withdraw linking permission without notice.

12. INDEMNIFICATION
You agree to indemnify, defend and hold harmless each of the Bamford Parties from and against any and all claims, lawsuits, demands, actions or other proceedings brought against it by any third party due to, arising out of or related to your (a) use of the Sites, (b) violation of these Terms of Use, or (c) violation of any law, regulation or third party rights. You shall pay any and all costs, damages and expenses, including, without limitation, reasonable attorneys' fees and costs awarded against or otherwise incurred by the Bamford Parties in connection with or arising from any such claim, lawsuit, action, demand or other proceeding.
If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
14. SEVERABILITY
Each of the paragraphs of these Terms of Use operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
15. WAIVERS
The failure by us to enforce any right or provision of these Terms of Use will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Bamford.
16. ENTIRE AGREEMENT
These Terms of Use, and the other applicable terms referenced and hereby incorporated into these Terms of Use, constitutes the entire agreement between you and us with respect to the Site and Content and supersedes and replaces all prior agreements. The section titles in these Terms of Use are for convenience only and have no legal or contractual effect.
